Booking
At the time of booking, $50 non-refundable deposit is required to secure your appointment date and time. Your session deposit can be made in the form of Cash, Cash App, Zelle, or Apple Pay. Appointments made without deposit may not be honored and are subject to cancellation. Payment of the deposit is required at the time of booking and has a 24-hour grace period. Deposits that are not paid within 24 hours of setting an appointment may not be honored and subjects the appointment to cancellation. Payment of the deposit acts as an agreement to all of the Acoustix Productions policies. Collaborations/Creative Endeavors booked with no monetary gain give Acoustix Productions ALL rights to photos and video taken and can be used however/whenever we see fit.
Payment
Sessions must be paid in full prior to shoot or event date or immediately after the shoot/event via Cash, Cash App, Zelle, or Apple Pay. Checks are not accepted. An additional $20 surcharge will be added on all sessions where client is beyond 30 minutes late. Session end times will not be extended to accommodate client lateness.

Cancellation
If you are unable to make your photo/video session all deposits will act as a cancellation fee. 72 hours of advance notice of cancellation is required in order to credit the deposit towards a future session or a half refund. If not notified within 24 hours of the session the half deposit rule is cleared and there will be no refund BUT the client can reschedule for FREE on a day that fits the photographers schedule within 3 months. The photographer reserves the right to deny service to any client(s) who repeatedly have a history of cancellations. If Acousix Productions cannot perform this contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to illness or emergency, then the Videographer/Photographer shall return the retainer fee to the client, but shall have no further liability with respect to the contract. This shall also apply in the event that photographic materials are damaged in processing, lost through camera or other media malfunction, lost in mail or otherwise lost or damaged without fault on the part of the Photographer. In the event Acoustix Productions fails for any other reason, Acoustix Productions shall not be liable for any amount in excess of all monies paid. 
Photography & Video

USAGE RIGHTS AND OWNERSHIP:
Client acknowledges that Photographer is the Author of the Image(s) and also the first and sole owner of all copyrights of the Image(s). The Image(s) and all copyrights remain the exclusive property of Photographer without limitation. All usage rights to the Image(s) specifically granted by Photographer to Client appear on the reverse side of this Agreement. 
IMAGES ARE LICENSED FOR SPECIFIC USE(S) AND ARE NOT SOLD.
Client understands and agrees that it is not buying the Image(s) but is paying only for a license to use the Image(s) as specified on this Agreement.
The term of license begins from the date Photographer receives full payment of invoice and upon delivery of images.
Unless otherwise agreed, Photographer retains the right to use the Image(s) for his self-promotion.
GENERAL LIABILITY AND RELEASES:
Photographer will take all reasonable care in the production of the Image(s) and the performance of this agreement. But Photographer will not be liable for any loss, damages, or costs, suffered by Client, or by any third party, arising from Client’s use of any Image(s).

Client will indemnify, defend, and hold harmless, Photographer, his contractors, and her representatives, against any and all claims, liabilities, damages, costs, and expenses, including reasonable legal fees and expenses, that may arise from Client’s use of any Image(s).
GENERAL LIABILITY AND RELEASES:
Photographer is not responsible for obtaining model, property, trademark, copyright, or any other, releases in connection with the Image(s) unless specifically stated in this Agreement. It is Client’s responsibility to obtain all necessary permissions for any Image use that requires a release or other consents.

Should Photographer agree to deliver any releases, it is Client’s responsibility to determine whether such releases are suitable for Client’s purposes. Photographer gives no warranty or guarantee as to the legal validity of any release.
In any event, Photographer’s liability for all claims will not exceed the total amount paid under this Agreement.
FAILURE TO PERFORM:
If Photographer is unable to supply his photographic services due to illness, mechanical breakdown, accident, acts of God, or any other cause beyond his control, then Photographer will attempt to procure the services of another professional photographer to fulfill his obligations. If that does not succeed, Photographer will return any fees paid by Client and will have no further liability with respect to this Agreement, and Photographer will not be responsible or liable for any other damages beyond the amount of this Agreement.
This limitation of liability will also apply in the event that any Image is lost or damaged through equipment malfunction, or otherwise, without the fault of Photographer.
KILL FEE:
Provided that Photographer has executed the photography assignment in a professional and competent manner, Client agrees to pay Photographer all fees and expenses in connection with said assignment, whether or not Client uses any Image(s).
ARCHIVING DIGITAL FILES:

While Photographer may choose to archive the Image(s), it is Client’s responsibility to properly store and archive the Image(s) for the duration of the term of license. Photographer cannot guarantee the availability of any Image(s) beyond the date of first delivery to Client.

Client is aware that optical, magnetic, electronic, and any other, media for storing digital data are inherently unstable. Client hereby releases Photographer and his contractors, and representatives, from any liability for any claims, damages, or costs, arising from any media supplied by Photographer becoming unusable.

All digital files created by, or on behalf of, Client that contain any Image(s) will be deleted or destroyed within ten days after the expiration date of license.

Any requests for the photographer to reproduce images that were already delivered will incur a $100 processing fee. 

DIGITAL FILE QUALITY:

Photographer is committed to providing high quality services. Unless otherwise specified, Photographer may deliver, and Client agrees to accept, the Image(s) encoded in an industry-standard data format that Photographer may select, at a resolution that Photographer determines will be suitable to the reproduction technology and use(s) for which the Image(s) is licensed.

Photographer uses cameras and monitors that are color calibrated to industry standards. But due to variances in other monitors, software and computer platforms, the Image(s) may display differently on other monitors. Therefore, neutrals will be set for mathematical neutrality and color will be adjusted for pleasing tonalities.

It is Client’s responsibility to verify that the digital data, including color profile, if provided, are suitable for reproduction of the expected quality and color accuracy, and that all necessary steps are taken to ensure correct reproduction. If the data are not deemed suitable, Photographer’s sole obligation will be to replace or repair the data, but in no event will Photographer be liable for poor reproduction quality, delays, losses, expenses, or consequential damages, resulting directly, or indirectly, from defects or errors in digital files or their use.
All editing is done at the photographer’s discretion. The photographer reserves the right to refuse any additional edits requested.  Some images may only be produced in color or black and white at the artists discretion. If the client(s) wish to request additional editing of images this is done at a separate fee starting at $50 per image.

360 Photo Booth Service Agreement, Terms & Conditions
Reservation and Payment Information
Reservation Fees:
1. ​Client is required to pay a non-refundable reservation/retainer’s fee in the amount of $100 in order to secure reservation which will be applied towards the total cost. All remaining balance(s) will be due prior to service.

Venue and Event Space
Client responsibility: Photo Booth
1. Arrange for an appropriate space of 10’x10’ for the 360 Photo Booth at the event's venue.
2. Provide a standard three-prong wall outlet to power the booth.
3. Provide a level area of ground for the booth and a roof, awning, or canopy for potential inclement weather.
Contractor responsibility:
1. Designate a primary point of contact to all matters pertaining to this Agreement. A number of employees or agents that it deems sufficient to perform the Services set out in The Scope of Work to include:
•           Full-Time Attendant
•           Lighting system
•           Four-point colored up lighting
•           Sharing from the booth via email, text, or QR scan
•           Electronic copy of all images via an online photo gallery
•           Stanchions and red velvet ropes
2. Provide all necessary equipment/accessories needed to perform the requested duties to include 1 x 360 Photo Booth, 1 x I Pad /camera device, crowd control stanchions, lighting, folding table, cords and cables.
3. Arrive approximately 1 hour (one) prior to set up and perform all pre-event checks and troubleshooting procedures as necessary.
4. Perform all pre-event sound checks and necessary troubleshooting procedures.
Service Period:
1. 360 Photo Booth will be performed from start to finish for the amount of consecutive hours agreed upon and scheduled.
2. In the event “idle time” is requested to which the client ask contractor/attendant to momentarily suspend 360 Photo Booth Service at any point throughout the event for any purpose (i.e. dinner, special presentations, etc.), the client shall remain responsible for covering the full cost of service during the break.

Damages, Loss & Liability:
Client acknowledges and agrees to:
1. Cover for all damage expenses to 360 Photo Booth equipment and accessories listed above due to negligence of customer or any of the event guests.
2. Be held responsible for any damage or loss to the Provider's Equipment caused by any misuse of the provider's equipment by Client or its guests both invited and uninvited. 
3. Indemnify (or hold harmless) provider against any and all liability related to Client’s event during or after Client’s event.
4. Indemnify (or hold harmless) provider from the time of service into the future, against any and liability associated with Client’s event.
5. Indemnify (or hold harmless) provider against any and all liability associated with the use of pictures and videos taken with the Acoustix Productions Photo Booth, its representatives, employees or affiliates at Client's event.​
6. further grants the Acoustix Productions the right to use any and all photographs or pictures captured on the 360 Photo Booth. The Customer further understands that said pictures, images, videos captured on the 360 Photo Booth may be used for artistic, promotional, or advertisement purposes. The Customer further releases the Service Provider, from any liability, that may occur from said pictures, videos, or imagining derived from or in any subsequent processing thereof, as well as any publication thereof, including without limitation any claims for libel, slander, or invasion of privacy.
7. IN NO EVENT SHALL SERVICE PROVIDER BE LIABLE TO CUSTOMER OR TO ANY THIRD PARTY FOR ANY LOSS OF USE, REVENUE, OR PROFIT OR FOR ANY CONSEQUENTIAL,INCIDENTAL, INDIRECT, EXEMPLARY, SPECIAL, OR PUNITIVE DAMAGES WHETHER ARISING OUT OF BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, REGARDLESS OF WHETHER SUCH DAMAGE WAS FORESEEABLE AND WHETHER OR NOT SERVICE PROVIDER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND NOTWITHSTANDING THE FAILURE OF ANY AGREED OR OTHER REMEDY OF ITS ESSENTIAL PURPOSE.
8. IN NO EVENT SHALL SERVICE PROVIDER'S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT, WHETHER ARISING OUT OF OR RELATED TO BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EXCEED [[TWO (2) TIMES] THE AGGREGATE AMOUNTS PAID OR PAYABLE TO SERVICE PROVIDER PURSUANT TO THIS AGREEMENT.
Cancellation Policy:
PRIOR to the event:
1. Indoor and Outdoor: No changes/cancellations will be authorized after close of business (6 PM ET) the day prior of event. NO REFUNDS of booking fees or pre-paid balances will be authorized on the date of the event. No Exceptions.
2. Outdoor: if the Contractor is unable to perform service due to inclement weather forecast/conditions (i.e. rain, precipitation, high winds, lightning, etc.) an act of God or any other cause beyond the Contractor’s or customer’s control, the customer will be entitled to a refund of booking fee and all monies pre-paid toward remaining balance. The customer will be offered to reschedule reservation to a later date/time. The contractor will contact the customer NLT 24 hours prior to the event date to decide on a course of action.
DURING the event:
1. If performance of service is delayed, interrupted, or concludes ahead of the scheduled end time as a result of any act, omission of the customer, inclement weather conditions, or an act of God, the CUSTOMER will remain liable for total cost of service.
2. Cancellations due to circumstances not outlined in the above must requested and received in writing (or text/email) by the customer NLT 48 hours prior to the event date.
3. Contractor will retain all booking fees. Customer may be entitled to refund of all pre-paid balances at contractor’s discretion.
4. If contractor cancels for any unspecified reasons, the customer will be entitled to a full refund of booking fees and monies pre-paid toward remaining balance. The customer may also be offered to reschedule reservation to a later date/time.
**360 Photo Booth: If, for whatever reason including injury or, illness the contractor’s attendant is unable to attend the event, contractor will make best efforts to find a substitute attendant for the event. If a substitute attendant cannot be found, Provider will promptly reimburse Client any and all Service Fee amounts Client previously paid to Provider, and neither party will have any further obligations or additional liability under this Agreement. All refunds will be issued via original payment method.
Acoustix Productions & Studios, LLC as an Independent Contractor:
Client understands and acknowledges:
1. Acoustix Productions attendant shall have the right to decline service to client's guest (invited or uninvited), for misuse, inappropriate photos or unruly behavior children who are unaccompanied by a responsible adult (18 or older).
Image and Video Policy
Turnaround time may vary depending on the volume of business experienced at the time images are being edited. Normal turnaround time for edited images are 7-14 business days from when the date the client selects images to be edited. The normal turnaround time for wedding edited images are 14-28 business days. Normal turnaround time for video edits is 14-28 days. 
When confirming booking, you are agreeing to the terms and conditions listed above.

Production Staff must be included in dinner arrangements during weddings and events over 8 hours.
